Our first speakers, Justice Kraft and Ms. Stathatos-Fulgieri will define actionable sexual harassment under the law, including physical, verbal and non-verbal harassment. Additionally, they will focus upon at risk individuals in healthcare with a focus on nurses and address harassment by patients, co-workers and superiors. Institutional liability under the doctrine of hostile work environment will be considered and procedural/policy standards proposed for risk mitigation purposes.

Mr. Wilkens will cover types of actions and inaction both institutionally and individually that often result in lawsuits, the role of Venue and jury pools in assessing the value of cases, increased patient volume from managed care. Mr. Barker will discuss how institutions and individuals should respond to a claim of alleged malpractice, general principles in defending malpractice claims, the defense perspective in how to assess the value of such cases and what can be done to reduce the risk of being sued again.
